تحلیل دیدگاههای متناقض موجود از حدود اختیارت قانونی رییس جمهور در ایران

چکیده

 موضوع حدود اختیارات رئیس‌جمهور در ایران همواره از موضوعاتی است که در اواخر دوران ریاست جمهوری افراد و شروع دوران انتخابات رسمی در محافل علمی و عمومی مطرح می‌شود و معمولا نیز دو دیدگاه کلی مبتنی بر تفسیر مضیق و در نقطه مقابل تفسیر موسع در این زمینه قابل مشاهده است؛ البته لازم است توجه داشته باشیم که دیدگاههای بینابینی نیز در این رابطه وجود دارد، چرا که رابطه میان این دو تفسیر «عموم و خصوص من وجه» است نه «تباین». در پژوهش پیش رو محدودیتهای ناشی از عوامل تاریخی، جغرافیایی، سیاسی، اقتصادی و فرهنگی و اجتماعی محل بحث نبوده و از موضع نزاع خارج است، زیرا این عوامل در محدوده وضع قوانین (قوه مقننه) و اجرای آن (قوه قضائیه) نیز وجود دارد و به عبارت دیگر همیشه و برای همه وجود دارند. در این تحقیق با رویکرد تحلیلی – توصیفی و ضمن برسی «قانون اساسی» و «قانون تعیین حدود وظایف و اختیارات و مسئولیتهای ریاست جمهوری اسلامی ایران»، به این نتیجه دست یافته‌ایم که حتی مطابق با دیدگاه مبتنی بر تفسیر مضیق نیز در حیطه اختیارات رئیس‌جمهور به عنوان مسئول اجرای قانون اساسی، محل نزاع در خارج از حیطه قوه مجریه است و نه در خود قوه مجریه و به عبارت دیگر اجرای قانون اساسی در قوه مجریه مسلما و به عنوان قدر مشترک در دامنه اختیارات رئیس‌جمهور واقع می‌شود  و حداقل آن است که هیچ رئیس‌جمهوری در خصوص عدم اختیار در این حوزه نمی‌تواند ادعایی داشته باشد

The issue of the authority of the president in Iran is always one of the topics that are in the presidency of Indviduals and the beginings of the officals elections in scientific and public circles, and as well as two general views of Mitney on the interpretation of the point of extensive survey, it is true that There is an interstitial View in this regard, because the relationship between these two interpretation (public publicy)is. In this research, with a descriptive analytical review, while reviewing the constitution and the law of determining the scope of the presidency and responsibilies of the Islamic Republic of Iran, we have concluded that even in accordance with the view of destrictive interpretation Also in the scope of the authority of the president as a responsible for the executive of the constitution, the place of conflict is outside the area of the executive branch, not in the executive branch Itseif. And in other words, the implementation of the constitution in the executive branch is located as a common magnitude of the president’s at least it is practice of his authority of other laws
